Personal information you disclose to us

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, apply for opportunities, inquire about opportunities, submit information or documents, participate in activities on the Services, or otherwise contact us.
Professional and contact files. If you apply for a job with us, inquire about employment or staffing opportunities, create an account, contact us, submit information or documents to us, are referred to us, or are identified or sourced through publicly available information, third-party platforms, recruiters, partners, job boards, professional platforms, data providers, social media, licensure databases, or other lawful sources, we may create and maintain a file about you as permitted by applicable law. This file may include information you provide to us directly, information generated through your interactions with us, and information lawfully obtained from third parties or public sources, including contact information, work history, professional qualifications, licensure, certifications, compliance-related information, job preferences, and other information relevant to employment, placement, recruiting, credentialing, compliance, customer support, or account administration.
Client and facility contact files. If you are a client, facility contact, employer representative, vendor contact, or business contact, we may create and maintain a file about you and your organization. This file may include your name, business contact information, title, employer or facility, job orders, service history, preferences, communications, account activity, and related business information. Internal communications, sales notes, account notes, service notes, and similar internal records are not shared externally except as required or permitted by law.
Personal Information Provided by You. The personal information we collect may include names, phone numbers, email addresses, mailing addresses, job titles, employment history, professional qualifications, resumes and profile information, references, emergency contact information, and account login information.
Sensitive Information. When necessary, with your consent or as otherwise permitted by applicable law, we process health data, medical compliance documents, vaccination records, drug screen information, background check information, information revealing race or ethnic origin, social security numbers or other government identifiers, driver's license, state identification, passport, or other identification information, citizenship, immigration, or work authorization information, student data, certifications, licenses, employment history, bank or direct deposit information, and tax forms.
Platform Data. If you use our website, web application, platform, or other online services, we may collect information necessary to operate, secure, and improve the Services, including account activity, feature usage, browser and device information, log data, and communication preferences. If we later make a mobile application available, we may update this notice or provide additional disclosures that apply to that application.
All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information. You may be able to review and update certain profile information directly through your account.

In order to enhance our ability to provide relevant marketing, offers, recruiting, staffing, placement, credentialing, compliance, account administration, and services to you and update our records, we may obtain information about you from other lawful sources, such as public databases, joint marketing partners, affiliate programs, data providers, job boards, professional networking platforms, licensure databases, social media platforms, referrals, staffing or vendor platforms, and other third parties.
2. HOW DO WE PROCESS YOUR INFORMATION?
In Short: We process your information to provide, improve, and administer our Services, communicate with you, support recruiting, staffing, placement, credentialing, compliance, security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.
We process your personal information for a variety of reasons, depending on how you interact with our Services, including:
- To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, verify your identity, complete SMS one-time password verification, and keep your account in working order.
- To create, maintain, review, and merge professional or contact files. We may process your information to create and maintain a record about you when you apply, inquire, communicate with us, submit information or documents, are referred to us, or are identified through lawful third-party or public sources. We may also process your information to authenticate you, prevent duplicate records, review inconsistencies, connect an existing file to a newly created account, and make certain profile information and user-uploaded documents available to you in your account after completion of our verification and review procedures.
- To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service, including recruiting, staffing, placement, job matching, credentialing, compliance, account administration, client support, facility support, and related services.
- To process resumes, profiles, credentials, and other professional information. We may process information you submit or that we lawfully obtain to extract, structure, summarize, validate, organize, match, and maintain information relevant to employment, staffing, placement, credentialing, compliance, or account administration.
- To use automated and AI-assisted tools. We may use automated tools, including AI-assisted tools, to help extract, parse, structure, summarize, validate, recommend, match, and process resumes, profiles, credentials, job orders, work history, preferences, skills, specialties, and related professional or business information. These tools may support internal workflows, recruiter review, candidate recommendations, job recommendations, profile improvements, and job matching. We do not make final hiring, placement, submission, pay, or assignment decisions solely by automated means. Human review remains involved.
- To improve our Services. We may use de-identified, aggregated, or otherwise privacy-protected information to improve our systems, workflows, parsing, matching, analytics, artificial intelligence tools, and Services. We do not use sensitive personal information, compliance documents, medical compliance records, government identification numbers, banking information, tax forms, background check results, drug screen results, or patient information to train public artificial intelligence models. Our service providers are not permitted to train their models on our data unless we expressly authorize that use in writing.
- To communicate with you. We may process your information to communicate with you about your account, profile, applications, job opportunities, staffing needs, service requests, credentialing, compliance, interviews, scheduling, assignments, payroll, timecards, or other service-related matters.
- To send marketing and promotional communications. We may process the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences. You can opt out of our marketing emails and marketing text messages at any time.
- To send SMS messages. We may send text messages for recruiting outreach, job alerts, application updates, interview scheduling, credentialing and compliance reminders, assignment updates, payroll and timecard reminders, account verification, one-time password verification, service-related communications, and marketing or promotional messages where permitted. Message frequency varies. Message and data rates may apply. You may opt out by replying STOP, and you may request help by replying HELP.
- To submit information to clients or placement opportunities. When you apply to, confirm interest in, or authorize submission for a specific job, assignment, facility, client, or placement opportunity, we may process and share relevant professional, credentialing, compliance, and application information with that client or opportunity.
- To comply with our legal obligations. We may process your information to comply with our legal obligations, respond to legal requests, and exercise, establish, or defend our legal rights.
- To remain in compliance with The Joint Commission and other applicable requirements. At times we may have requests from governing bodies, such as The Joint Commission, to produce records and information pertaining to individuals either on assignment, or previously on assignment with Gig Healthcare. We will, in these circumstances, use your information for compliance purposes only.
3. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?
In Short: We may share information in specific situations described in this section and/or with the following third parties.
We may need to share your personal information in the following situations:
- Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
- Service Providers. We may share your information with vendors, consultants, contractors, and other third-party service providers who perform services for us or on our behalf and require access to such information to do that work. These may include technology providers, cloud hosting providers, security providers, communication providers, analytics providers, resume parsing providers, AI-assisted processing providers, credentialing support providers, compliance support providers, background check providers, drug screen providers, payroll support providers, and similar service providers.
- Employment opportunities and client submissions. We may share your personal information with clients, facilities, employers, or prospective placement opportunities when you have expressly authorized, requested, or confirmed that we may do so in connection with a job opportunity, assignment, application, right-to-represent, submission, credentialing, onboarding, or related employment process. Authorization may occur through the Services, by clicking apply, by confirming interest, by email, by text, verbally with a recruiter, by signing a right-to-represent or other authorization, or by another clear job-specific approval.
- Internal workforce access. Access to professional or contact files is limited internally to personnel with a legitimate business need, such as recruiting, program management, compliance operations, account management, technology, leadership, and support.
- Legal, compliance, and safety. We may share information where we believe it is necessary to comply with applicable law, legal process, government requests, accreditation requirements, client requirements, investigations, security, fraud prevention, or to protect the rights, property, or safety of Gig Healthcare, our users, our clients, or others.
- No sale or unauthorized third-party disclosure. We do not sell your personal information. We do not disclose your professional or contact file to unrelated third parties except as described in this notice, with your authorization, or as required or permitted by law. We do not share your SMS consent with third parties or affiliates.
4. HOW LONG DO WE KEEP YOUR INFORMATION?
In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required or permitted by law.
We retain personal information for as long as reasonably necessary for the purposes described in this privacy notice, including to maintain accounts, maintain professional or contact files, provide services, support recruiting, placement, credentialing, compliance, account administration, customer support, security, fraud prevention, dispute resolution, and to comply with legal, regulatory, tax, accounting, contractual, accreditation, and recordkeeping obligations.
If you apply to us, inquire with us, send us information, are referred to us, are sourced from lawful third-party or public sources, or are otherwise included in our systems through lawful means, we may retain a professional or contact file about you even if you do not create or maintain an account with us, unless and until you request deletion and we are not required or permitted to retain the information for another lawful purpose.
When we have no ongoing legitimate business need or legal basis to process your personal information, we will either delete, anonymize, de-identify, or securely isolate such information.
5. HOW DO WE KEEP YOUR INFORMATION SAFE?

We do not knowingly solicit data from or market to children under 18 years of age. The Services are intended for users who are at least 18 years old. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 7. WHAT ARE YOUR PRIVACY RIGHTS?

Withdrawing your consent: If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time by contacting us using the contact details provided below. This will not affect the lawfulness of processing before withdrawal.
Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications at any time by replying STOP or UNSUBSCRIBE to SMS messages that we send, using the unsubscribe link in an email, or contacting us using the details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" We may still communicate with you for service-related, account-related, recruiting, credentialing, compliance, assignment, payroll, timecard, security, or other non-marketing purposes.
Account Information
If you would at any time like to review or change the information in your account or terminate your account, you can:
- Contact us using the contact information provided in "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below.
- Log in to your account settings and update your user account.
Profile verification and record merging. In some cases, we may already maintain a professional or contact file about you before you create an account with us. If you later create an account, we may require you to verify both the email address and phone number that match the information we have on file. Phone verification may include SMS one-time password verification. After that verification is completed, a Gig Healthcare administrator may manually review the account and contact you to resolve inconsistencies before merging records. Once the review is completed and the records are merged, we may make certain relevant information available in your account, such as profile information, parsed resume data, and documents you personally uploaded to us. Internal communications, recruiting notes, credentialing notes, admin-uploaded documents, client or facility notes, and similar internal records may be retained by us but may not be visible to you through your account.
We may delay, restrict, deny, correct, suspend, unmerge, or decline a profile merge or account access request if we cannot verify your identity, if information is inconsistent, if we identify duplicate activity, if we suspect fraud or unauthorized access, or if doing so is necessary to protect users, clients, Gig Healthcare, or our systems.
Requests for access, correction, deletion, or clarification. You may update certain information directly through your account interface. If you need additional access, correction, clarification, or deletion, you may contact us at support@gighealth.com or submit a request through our data request process. We may take reasonable steps to verify your identity before acting on any request.
Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases, subject to applicable law. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with investigations, enforce our legal terms, comply with applicable legal requirements, or fulfill other lawful purposes described in this notice.
8. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. We do not currently respond to DNT browser signals. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.
9. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?
In Short: If you are a resident of California, Colorado, Connecticut, Utah, Virginia, or another state with an applicable privacy law, you may have specific rights regarding access to your personal information.

- F. Internet or other similar network activity: Browsing history, search history, online behavior, interest data, and interactions with our websites, applications, systems, and advertisements. Collected: YES.

- H. Audio, electronic, visual, thermal, olfactory, or similar information: Images and audio, video, or call recordings created in connection with our business activities. Collected: NO.
- I. Professional or employment-related information: Business contact details, job title, work history, professional qualifications, resumes, credentials, licenses, certifications, job preferences, and staffing or placement information. Collected: YES.
- J. Education Information: Student records and directory information. Collected: YES.
- K. Inferences drawn from collected personal information: Inferences, recommendations, summaries, job matches, profile tags, or preferences drawn from collected personal information. Collected: YES.
- L. Sensitive personal information: Citizenship or immigration status, driver's licenses, state ID cards, passport numbers, health data, racial or ethnic origin, social security numbers, government identifiers, medical compliance information, drug screen information, background check information, tax forms, and banking or direct deposit information. Collected: YES.
We will use and retain collected personal information for as long as reasonably necessary for the purposes described in this notice, including account administration, recruiting, staffing, placement, credentialing, compliance, customer support, security, fraud prevention, legal obligations, accreditation, recordkeeping, and dispute resolution, unless deletion is requested and retention is not otherwise required or permitted by law.
We may also collect other personal information outside of these categories through instances where you interact with us in person, online, or by phone, text, email, or mail in the context of receiving help through customer support channels, applying for opportunities, communicating with recruiters, participating in surveys or contests, facilitating delivery of Services, and responding to inquiries.

We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider. We have not sold personal information in the preceding twelve (12) months. We will not sell personal information in the future belonging to website visitors, users, and other consumers. We do not share your SMS consent with any third parties or affiliates.

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits California residents to request and obtain from us, once a year and free of charge, information about categories of personal information, if any, disclosed to third parties for direct marketing purposes and the names and addresses of those third parties. Verification process
Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have information in our system. Verification may include confirming that the email address and phone number submitted in connection with a request match the information we have on file, SMS one-time password verification, manual review by a Gig Healthcare administrator, direct contact with you, or additional information where needed to resolve inconsistencies and protect against unauthorized access, fraud, or duplicate-profile activity.
Other privacy rights
- You may object to the processing of your personal information.
- You may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict processing of the information.
- You can designate an authorized agent to make a request on your behalf where permitted by law. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf.
